Terms of Service

1. Acceptance of Terms

By accessing or using CreatorMarket ("the Platform"), operated by Synexo Data Technology L.L.C, a limited liability company registered in the United Arab Emirates, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines posted on the Platform. If you do not agree to these Terms, you must not access or use the Platform.

2. Definitions

• "Platform" — The CreatorMarket website, applications, and related services accessible at creatormarket.ae.
• "User" — Any individual or entity that creates an account or uses the Platform.
• "Creator" — A User who registers as a content creator to offer influencer marketing services.
• "Brand" — A User who registers as a brand or business to discover and engage Creators.
• "Content" — Any text, images, videos, or other material uploaded to or created through the Platform.
• "Services" — Influencer marketing services offered by Creators, including but not limited to sponsored posts, stories, reels, and other content formats.

3. Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not have been previously suspended or removed from the Platform
• Comply with all applicable laws in your jurisdiction

If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

4. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• Each individual or entity may maintain only one account per role (Creator or Brand).

We reserve the right to suspend or delete accounts that contain inaccurate information or violate these Terms.

5. Description of Service

CreatorMarket is an online marketplace that connects Brands with content Creators in the UAE and the wider Middle East region. The Platform enables:

• Creators to list their services with transparent, fixed pricing in AED
• Brands to discover, evaluate, and contact Creators based on audience data and service offerings
• Direct communication between Brands and Creators through the Platform's messaging system
• Creators to showcase verified social media metrics and audience demographics

6. Role of the Platform

CreatorMarket is a marketplace that facilitates connections between Brands and Creators. We are not a party to any agreement, transaction, or collaboration between Users. We do not employ, manage, or control Creators, nor do we guarantee the quality, timing, or delivery of any Services.

7. User Conduct

All Users agree not to:

• Provide false, misleading, or inaccurate information in profiles, listings, or communications
• Impersonate any person, entity, or falsely represent an affiliation
• Harass, abuse, threaten, or discriminate against other Users
• Post spam, unsolicited advertisements, or promotional content outside designated areas
• Attempt to gain unauthorized access to the Platform, other accounts, or our systems
• Use the Platform for any illegal, fraudulent, or harmful purpose
• Scrape, crawl, or use automated means to extract data from the Platform
• Circumvent the Platform to avoid fees or to conduct transactions off-platform after initial contact
• Upload malicious code, viruses, or any material that could harm the Platform or its Users

8. Creator Responsibilities

As a Creator, you agree to:

• Maintain a complete profile before making it publicly visible — including a profile photo, bio, at least one connected social media account, and clearly defined service offerings with pricing — so that Brands can make informed decisions
• Accurately represent your services, capabilities, pricing, and audience metrics
• Deliver agreed-upon content within agreed timelines and to a professional standard
• Maintain professional and respectful communication with Brands
• Disclose sponsored content in accordance with applicable UAE advertising regulations and platform guidelines
• Obtain and maintain any licenses or permits required by UAE law for advertising activities, where applicable
• Not artificially inflate follower counts, engagement metrics, or audience demographics
• Ensure that all content you create complies with applicable laws and does not infringe third-party rights

9. Brand Responsibilities

As a Brand, you agree to:

• Clearly communicate campaign requirements, expectations, and deliverables
• Make timely payments as agreed with Creators
• Treat Creators with respect and professionalism
• Provide accurate information about your company and campaigns
• Not request content that violates applicable laws, regulations, or third-party rights
• Obtain necessary rights and permissions before using Creator content beyond the agreed scope

10. Verification & Advertising Permits

Identity Verification

Creators may submit government-issued identification (e.g., Emirates ID, Driver's License) for identity verification. A "Verified Identity" badge confirms that the Platform has reviewed the submitted document. It does not guarantee the authenticity of social media profiles, follower counts, or the quality of services.

Advertising Permit

Creators may submit an advertising or media permit issued by a UAE authority for review. Upon approval, a "Licensed Advertiser" badge is displayed on the Creator's public profile. By uploading a permit, you represent and warrant that:

• The document is genuine, unaltered, and issued to you or an entity you are authorized to represent
• The permit is currently valid and has not expired or been revoked
• You will promptly notify CreatorMarket if the permit expires, is revoked, or becomes invalid

CreatorMarket reserves the right to revoke the Licensed Advertiser badge at any time if the submitted document is found to be fraudulent, expired, or otherwise invalid. The badge indicates that a document was reviewed; it does not constitute legal advice or a determination of regulatory compliance.

Document Handling

Verification documents and advertising permits are stored securely and accessed only by authorized personnel for review purposes. Documents are not publicly displayed, shared with other Users, or used for any purpose beyond verification. See our Privacy Policy for details on document retention and deletion.

11. Payments

All payments for Creator services are currently handled directly between Brands and Creators outside the Platform. CreatorMarket does not process, hold, or mediate payments between Users.

• CreatorMarket is not responsible for payment disputes between Users
• We strongly recommend using secure payment methods and maintaining written agreements
• Creators set their own prices; CreatorMarket does not control or endorse pricing
• All prices displayed on the Platform are in UAE Dirhams (AED)

12. Content & Intellectual Property

Your Content

You retain ownership of all Content you upload to the Platform (profile information, images, portfolio items, campaign descriptions). By uploading Content, you grant CreatorMarket a non-exclusive, worldwide, royalty-free license to display, distribute, and reproduce your Content solely for the purpose of operating and promoting the Platform.

Creator Work Product

Content created by Creators as part of a collaboration with a Brand remains the Creator's intellectual property unless otherwise agreed in writing between the Creator and Brand. Brands should negotiate usage rights, exclusivity, and licensing as part of their agreements with Creators.

Platform Intellectual Property

The CreatorMarket name, logo, design, and all software, features, and technology powering the Platform are the property of Synexo Data Technology L.L.C and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Platform without our prior written consent.

13. Social Media Integrations

CreatorMarket allows Creators to connect supported social media properties via OAuth authorization, including Instagram professional accounts and Facebook Pages. CreatorMarket is not affiliated with, endorsed by, or operated by Meta Platforms, Inc. By connecting a supported account or page, you:

• Authorize Data Access — You grant CreatorMarket permission to access supported profile, page, audience, and engagement metrics through the respective platform's API. We only access data that you explicitly authorize through platform permissions, including instagram_business_basic, instagram_business_manage_insights, pages_show_list, pages_read_engagement, and read_insights.
• Retain Ownership — You retain full ownership of your connected social media accounts and associated data at all times. You can manage or revoke CreatorMarket's access via your Meta account settings.
• Accept Data Accuracy — While we strive to display accurate data, metrics such as follower counts, page counts, audience insights, and engagement rates are sourced from third-party APIs and may not always reflect real-time values. Data provided via third-party APIs is subject to availability, accuracy, and limitations imposed by those platforms.
• Can Disconnect Anytime — You may disconnect a connected social media account or page at any time through your dashboard settings. Upon disconnection, all associated Meta data — including the encrypted access token, synced metrics, imported media that we can attribute to that connection, and the social-account record itself (including the stored username and profile link) — is permanently deleted from our systems.
• Comply with Platform Terms — By using the social media integrations, you also agree to comply with the applicable terms and policies of each connected platform, including the Meta Platform Terms and the Meta Terms of Service.

Meta Media Import

The Platform allows Creators to import images from their connected Instagram account or Facebook Page for use as profile photos or portfolio items. By using this feature, you:

• Confirm Rights — You represent and warrant that you own or hold sufficient rights to all images you import, and that their use on CreatorMarket does not infringe any third-party intellectual property, privacy, or publicity rights.
• Accept Processing — You acknowledge that imported images are downloaded from the connected Meta service, stored on our servers, and processed to generate optimized display variants. Imported images are stored solely for use within the Platform — specifically as the Creator's profile photo or portfolio items — and are not used for any purpose outside of the Creator's profile and portfolio display. Once imported, the stored copy is not linked to or updated from the source platform.
• Accept Public Display — Imported images used as your profile photo or portfolio are publicly visible to all Users and visitors of the Platform.
• Accept Availability Limitations — Source media URLs may be temporary. Once an image is imported and processed, it is served from our infrastructure. If the import fails because the source platform has removed or blocked the media, CreatorMarket is not responsible for the unavailability of the source image.

Restrictions on Meta Platform Data

Data obtained from Meta platforms is used strictly for the purposes described in these Terms and our Privacy Policy, and for no other purposes. Specifically, Meta Platform data is used solely to:

• Display the connected account's information and metrics (such as username, follower count, and aggregated engagement rate) on the Creator's CreatorMarket profile
• Allow the Creator to select and import their own media (images from their connected Instagram account or Facebook Page) into their CreatorMarket profile or portfolio
• Enable profile customization and portfolio features within the Platform

In addition:

• We do not sell, license, or transfer Meta Platform data to third parties.
• We do not combine data from different users to create independent profiles outside the functionality of the Platform.
• We do not use Meta Platform data for advertising, retargeting, building user segments, or any other purpose outside the features described above.
• We access Meta APIs in compliance with their rate limits and usage policies.

Security and Storage

We store access tokens in encrypted form (AES-256-GCM) and never share them with third parties. You can request deletion of your stored Meta connection data at any time: https://creatormarket.ae/data-deletion. For more details, see our Privacy Policy.

14. Fees

Creating an account and browsing the Platform is currently free. CreatorMarket reserves the right to introduce fees, subscriptions, or commission-based pricing in the future. Any such changes will be communicated to Users in advance, and continued use of the Platform after the introduction of fees constitutes acceptance.

15. Termination

You may delete your account at any time through your dashboard settings. Upon deletion, your profile and associated data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent or harmful behavior, or remain inactive for an extended period. Any misuse of connected platform data or violation of third-party platform policies (including Meta Platform Terms) may result in immediate suspension or termination. We will provide notice where reasonably possible.

16. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or secure
• The information provided by Users (including audience metrics) is accurate or complete
• Any particular outcome will result from using the Platform
• The Platform will meet your specific requirements

17. Limitation of Liability

To the maximum extent permitted by applicable law, Synexo Data Technology L.L.C and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Disputes between Users, including payment disputes or quality of delivered content
• Actions or omissions of third-party services (including social media platforms)
• Unauthorized access to or alteration of your data

Our total liability for any claim arising from or related to these Terms or the Platform shall not exceed the amount you have paid to CreatorMarket in the twelve (12) months preceding the claim, or AED 500, whichever is greater.

18. Indemnification

You agree to indemnify, defend, and hold harmless Synexo Data Technology L.L.C, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Platform, Content you upload or distribute, your interactions with other Users, or your violation of these Terms or any applicable law.

19. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy.

20. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, by email or through a notice on the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

21. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least thirty (30) days.

22. General Provisions

Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Synexo Data Technology L.L.C regarding the use of the Platform.

No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Force Majeure. We shall not be liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, pandemics, government actions, or infrastructure failures.
