Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the CreatorMarket website, mobile applications, and related services (collectively, the "Platform").
By creating an account, accessing, or using the Platform, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, you must not access or use the Platform.
1. Operator

2. Definitions
- "Brand" means a User who uses the Platform to discover, contact, evaluate, or book Creators, create campaigns, or otherwise seek Creator services.
- "Creator" means a User who creates a Creator profile, offers Creator services, applies to campaigns, or accepts booking requests.
- "Creator Services" means influencer marketing, content creation, promotional, advertising, or related services offered by a Creator, including posts, stories, reels, videos, appearances, user-generated content, photography, and other agreed deliverables.
- "Platform Content" means software, designs, text, graphics, branding, databases, features, and other material provided by CreatorMarket, excluding User Content.
- "User" means any individual or legal entity that accesses or uses the Platform.
- "User Content" means text, images, links, package information, campaign information, messages, documents, and other material uploaded, imported, submitted, or published by a User.
3. Eligibility and Authority
You must be at least 13 years old to use the Platform. If you are under the age of majority in your country of residence, you confirm that you have permission from a parent or legal guardian to use the Platform.
You must not use the Platform if you have previously been permanently removed from it, unless CreatorMarket expressly authorizes your return.
If you use the Platform on behalf of a company, Brand, agency, or other organization, you represent that you have authority to act for and bind that organization.
You are responsible for complying with all laws, licences, permits, disclosure rules, and professional requirements that apply to you, your activities, and your use of the Platform.
4. Accounts and Account Security
You must provide accurate, complete, and current information when creating and maintaining an account.
You are responsible for:
- maintaining the confidentiality and security of your login credentials;
- all activity carried out through your account;
- keeping your email address and other account information current; and
- notifying CreatorMarket promptly if you suspect unauthorized access or misuse.
You must not:
- create an account using false or misleading information;
- impersonate another person or organization;
- sell, transfer, rent, or share an account without authorization;
- use another User's account without permission; or
- create accounts to evade a suspension, restriction, or enforcement action.
CreatorMarket may require additional information where reasonably necessary to verify account ownership, investigate misuse, comply with law, or protect the Platform and its Users.
5. Description of the Platform
CreatorMarket provides marketplace and technology tools through which:
- Creators may create public profiles, display portfolio images, list social media accounts, create service packages, state prices, apply to campaigns, communicate with Brands, and receive booking requests;
- Brands may discover and evaluate Creators, communicate with them, create campaigns, receive applications, and make booking requests;
- Users may communicate through private chat;
- Creators may optionally connect supported social media accounts and import authorized profile information, media, statistics, or audience insights;
- Creators may submit documents for limited review and may receive a related Platform badge; and
- Users may purchase optional digital Platform features where available.
CreatorMarket may add, change, limit, suspend, or discontinue features at any time.
6. Role of CreatorMarket
CreatorMarket provides an online marketplace, discovery service, communication system, and booking technology.
Unless CreatorMarket expressly states otherwise:
- CreatorMarket does not provide the Creator Services;
- CreatorMarket does not employ, manage, control, or represent Creators;
- CreatorMarket does not act as an agent for a Brand or Creator;
- CreatorMarket is not a party to the agreement for Creator Services between a Brand and a Creator;
- CreatorMarket does not provide escrow for payments between Users;
- CreatorMarket does not decide the commercial terms of a collaboration; and
- CreatorMarket does not guarantee that a booking, campaign, collaboration, payment, or business relationship will be completed or successful.
Any agreement for Creator Services is entered into directly between the relevant Brand and Creator. Those Users are solely responsible for agreeing on the scope, deliverables, deadlines, approvals, compensation, payment schedule, content usage rights, exclusivity, cancellation terms, disclosures, and all other conditions of their collaboration.
7. User-Provided Information and No Platform Guarantee
Users are solely responsible for all information they submit, publish, display, or communicate through the Platform.
This includes, without limitation:
- names, biographies, locations, profile information, experience, qualifications, and portfolio material;
- social media usernames, account ownership statements, follower or subscriber counts, audience demographics, engagement information, reach, views, and other performance data;
- Creator services, package descriptions, prices, availability, deadlines, and deliverables;
- Brand information, campaign descriptions, requirements, budgets, compensation, benefits, and payment promises;
- licences, permits, approvals, verification documents, and regulatory statements;
- applications, booking information, messages, and statements made to another User; and
- the authenticity, legality, accuracy, and ownership of uploaded or imported content.
CreatorMarket does not generally independently audit User-provided information and does not warrant that it is accurate, complete, current, lawful, genuine, or not misleading.
CreatorMarket may review, moderate, compare, format, display, or remove information for Platform operation and safety. Such actions do not create a guarantee, certification, endorsement, recommendation, or assumption of responsibility by CreatorMarket.
Users must independently verify any information that is important to a booking, campaign, collaboration, payment, regulatory decision, or other transaction.
8. Social Media Metrics and Third-Party Data
Certain information displayed through CreatorMarket may be supplied by a User or obtained through supported third-party services such as Instagram, Facebook, TikTok, or YouTube.
Follower and subscriber counts, audience demographics, engagement rates, impressions, reach, views, watch time, and similar information may be:
- delayed or not real-time;
- incomplete or unavailable;
- subject to privacy thresholds;
- calculated or summarized from third-party data;
- affected by changes to third-party APIs, definitions, policies, or systems; or
- inaccurate due to User input, third-party errors, manipulation, fraud, or other factors outside CreatorMarket's control.
CreatorMarket does not guarantee that any social media metric represents a Creator's actual current audience, genuine engagement, commercial value, suitability, identity, account ownership, or likely campaign performance.
No social media connection, metric, profile, badge, ranking, or search position constitutes an endorsement or recommendation by CreatorMarket.
9. General User Conduct
You must not use the Platform to:
- violate applicable laws, regulations, court orders, or third-party rights;
- provide false, fraudulent, deceptive, or materially misleading information;
- impersonate another person, Brand, company, authority, or organization;
- harass, threaten, intimidate, bully, exploit, or discriminate against another person;
- promote violence, illegal activity, hate, pornography, sexual exploitation, or harmful conduct;
- send spam, repeated unwanted solicitations, scams, phishing attempts, or malicious links;
- upload viruses, malware, harmful code, or content designed to disrupt the Platform;
- gain or attempt to gain unauthorized access to accounts, data, systems, or infrastructure;
- scrape, crawl, copy, harvest, index, or extract Platform data through automated means without written permission;
- manipulate searches, rankings, metrics, followers, engagement, reviews, badges, campaigns, or Platform features;
- use the Platform to launder money, evade sanctions, commit fraud, or conceal illegal activity;
- collect or disclose another person's private or personal information without a lawful basis;
- reverse engineer, interfere with, overload, or bypass security or usage controls; or
- use CreatorMarket branding or User Content in a misleading or unauthorized manner.
10. Creator Responsibilities
Creators must maintain an accurate and sufficiently complete profile before making it publicly visible.
A complete Creator profile may require:
- a profile picture;
- portfolio pictures;
- a biography;
- a username and display name;
- a location;
- the name or username of at least one social media account; and
- at least one service package with a description and price.
Connecting a social media account through OAuth is optional unless a particular optional feature clearly states otherwise.
Creators are responsible for:
- accurately describing their identity, experience, audience, services, availability, pricing, and capabilities;
- ensuring that social media accounts listed or connected by them are owned or lawfully controlled by them;
- delivering agreed Creator Services professionally and within agreed timelines;
- communicating clearly with Brands;
- complying with advertising disclosures, intellectual-property rules, platform rules, and applicable laws;
- obtaining and maintaining any licence, permit, approval, or registration required for their activities;
- ensuring that their content and services do not infringe third-party rights;
- keeping package prices, availability, permits, and profile information current; and
- promptly informing the relevant Brand of any issue that may affect performance.
Creators must not artificially inflate or manipulate follower counts, engagement, audience data, views, applications, or other metrics.
11. Brand Responsibilities
Brands are responsible for:
- providing accurate information about themselves and their campaigns;
- clearly stating campaign requirements, deliverables, timelines, compensation, and usage expectations;
- ensuring that campaign requests comply with applicable laws and third-party rights;
- making payments and providing benefits as agreed with the Creator;
- communicating professionally and in good faith;
- obtaining agreed rights before using, editing, publishing, licensing, or distributing Creator work;
- not requesting unlawful, misleading, dangerous, discriminatory, infringing, or undisclosed advertising content; and
- conducting appropriate checks before engaging or paying a Creator.
Campaign prices, budgets, compensation, product benefits, and other commercial terms are entered by the relevant Brand. CreatorMarket does not approve, endorse, fund, secure, or guarantee them.
12. Bookings, Collaborations, and User-to-User Payments
Bookings and other Platform records help Users organize and document interactions. They do not make CreatorMarket a party to the underlying Creator Services agreement.
Unless a specific CreatorMarket feature expressly states otherwise:
- payments for Creator Services are arranged directly between Brands and Creators;
- CreatorMarket does not collect, hold, safeguard, or release those funds;
- CreatorMarket does not provide escrow;
- CreatorMarket does not guarantee payment, delivery, quality, results, or refunds; and
- CreatorMarket does not decide disputes between Users.
Users should agree in writing on all material collaboration terms before work begins.
CreatorMarket is not responsible for:
- non-payment, late payment, chargebacks, or payment fraud between Users;
- incomplete, late, unsuitable, unlawful, or poor-quality work;
- disagreements about scope, revisions, approval, cancellation, or results;
- use of Creator content outside the agreed scope;
- loss of products, samples, access, confidential information, or business opportunities; or
- tax, licensing, employment, agency, or regulatory consequences of a User relationship.
CreatorMarket may provide support or review Platform records, but doing so does not create an obligation to mediate, compensate, refund, or enforce a User agreement.
13. Platform Purchases and Store Billing
CreatorMarket may offer optional digital Platform features, including subscriptions, badges, boosts, enhanced visibility, or other digital benefits.
Purchases made through the Apple App Store or Google Play are processed through the applicable store's billing system. Product details, prices, duration, renewal terms, and included benefits are displayed before purchase.
Where a subscription is offered:
- it may automatically renew unless cancelled through the applicable store;
- billing and cancellation are managed through the User's Apple or Google account; and
- access may end when the subscription expires, is cancelled, refunded, revoked, or cannot be validated.
Refund requests and refund decisions are handled under applicable law and the relevant store's policies. CreatorMarket does not control Apple's or Google's refund decisions.
Purchasing a badge subscription, a visibility boost, or any other paid Platform feature does not guarantee:
- approval or continued display of a badge;
- a particular profile position, number of views, booking, application, collaboration, or income;
- the accuracy of User information; or
- any commercial result.
14. Limited Document Review and Verification Badges
CreatorMarket may allow Creators to submit identity documents, advertising permits, media permits, or similar documents and may display a related badge following a limited review.
CreatorMarket's review is limited to a visual assessment of the submitted document for apparent completeness, consistency, visible validity information, and obvious signs of alteration or irregularity.
Unless expressly stated otherwise, CreatorMarket does not:
- conduct forensic document authentication;
- verify a document directly with the issuing authority;
- access or check a government database;
- perform biometric, facial-recognition, video, or live-person verification;
- confirm that the person operating the account is the person named in the document;
- guarantee that a document has not been forged, altered, stolen, revoked, cancelled, or fraudulently obtained; or
- provide legal or regulatory advice.
14.1 Verified Identity Badge
A "Verified Identity" badge means only that an identity document submitted for the relevant account passed CreatorMarket's limited visual review at the time of review.
It does not guarantee:
- the authenticity of the document;
- the identity of the person operating the account;
- that the document belongs to the account holder;
- the Creator's honesty, trustworthiness, qualifications, services, audience, or social media accounts; or
- the accuracy of any other profile information.
14.2 Media Permit or Licensed Advertiser Badge
A "Media Permit", "Licensed Advertiser", or similar badge means only that a submitted permit or authorization document passed CreatorMarket's limited visual review at the time of review.
It does not guarantee:
- that the document is genuine;
- that it was issued to the person operating the account;
- that it remains valid, active, applicable, or unrevoked;
- that it covers every service, platform, campaign, or activity offered by the Creator;
- that the Creator complies with all regulatory requirements; or
- that any government authority has approved or endorsed CreatorMarket or the Creator.
14.3 User Responsibility for Documents
A User submitting a document represents and warrants that:
- the document is genuine, complete, unaltered, and lawfully obtained;
- the document belongs to the User or an entity the User is authorized to represent;
- all related information is accurate;
- the document is valid and has not expired, been suspended, cancelled, or revoked; and
- CreatorMarket will be informed promptly if its validity or status changes.
14.4 Badge Removal
CreatorMarket may reject a document or remove, suspend, or revoke a badge at any time if:
- the document appears incomplete, inconsistent, altered, expired, or invalid;
- CreatorMarket receives information questioning its authenticity or validity;
- the User does not provide reasonably requested information;
- the relevant criteria or laws change; or
- continued display may create legal, regulatory, security, reputational, or User-safety risk.
Badges are limited Platform indicators only. They are not warranties, certifications, endorsements, recommendations, or guarantees.
To the maximum extent permitted by law, CreatorMarket is not responsible for losses resulting from forged, altered, stolen, expired, revoked, or fraudulently submitted documents that were not reasonably identifiable through the limited review described in these Terms.
15. User Content and Intellectual Property
15.1 Ownership
Users retain ownership of their User Content, subject to any rights belonging to other persons.
15.2 Licence to Operate the Platform
By uploading, importing, submitting, or publishing User Content, you grant CreatorMarket a non-exclusive, worldwide, royalty-free, sublicensable licence to:
- host, store, reproduce, resize, format, process, transmit, and display the User Content;
- make it available according to your selected visibility and Platform settings;
- operate bookings, profiles, packages, campaigns, chat, search, and other Platform features;
- moderate, investigate, secure, support, and protect the Platform; and
- comply with legal obligations.
This licence is limited to operating, providing, securing, and moderating the Platform. CreatorMarket will not use your profile or portfolio content in external advertising campaigns without separate permission, except for ordinary technical previews, links, or displays that you have made publicly available through the Platform.
The licence ends when the relevant User Content is deleted, except where temporary technical copies, legal retention, safety records, or backups remain as described in the Privacy Policy.
15.3 Your Responsibility for Content
You represent and warrant that:
- you own the User Content or have all rights and permissions needed to use and submit it;
- publication and use of the User Content through CreatorMarket does not infringe copyright, trademark, privacy, publicity, confidentiality, contractual, or other rights;
- people identifiable in uploaded content have been included lawfully;
- the User Content is accurate where it is presented as factual; and
- the User Content complies with these Terms and applicable law.
15.4 Creator Work Product
Content created by a Creator for a Brand remains owned by the party agreed between the Creator and Brand.
CreatorMarket does not determine ownership, usage rights, exclusivity, licensing duration, territories, media channels, editing rights, or reuse rights. Brands and Creators must agree on these matters directly.
15.5 Removal and Preservation
CreatorMarket may remove, restrict, hide, preserve, or disable access to User Content where reasonably necessary to enforce these Terms, protect Users, investigate reports, preserve evidence, comply with law, or reduce risk.
16. Prohibited Content, Reporting, Blocking, and Moderation
Users must not upload, publish, send, or share content that:
- is illegal or promotes unlawful conduct;
- is false, fraudulent, deceptive, defamatory, or materially misleading;
- contains hate, harassment, bullying, threats, exploitation, or discrimination;
- contains pornography, sexually explicit content, or sexual exploitation;
- encourages violence, self-harm, dangerous conduct, or abuse;
- infringes intellectual-property, privacy, publicity, confidentiality, or contractual rights;
- contains another person's private data without a lawful basis;
- impersonates another person or organization;
- contains malware, malicious links, spam, or scams; or
- otherwise creates material legal, safety, or reputational risk.
CreatorMarket may use technical controls, moderation, review procedures, reporting tools, and blocking tools to reduce abuse.
Users may report profiles, campaigns, messages, transactions, or other supported content. CreatorMarket may investigate and take appropriate action based on the severity, context, available evidence, and legal requirements.
Possible actions include:
- issuing a warning;
- requesting changes or additional information;
- hiding or removing content;
- restricting messaging or Platform features;
- removing a badge;
- disconnecting a social integration;
- suspending or terminating an account; or
- reporting activity to an authority where legally required or appropriate.
Blocking may limit communication and visibility between Users as supported by the Platform.
CreatorMarket does not guarantee that all objectionable content will be identified before it is displayed or sent.
17. Connected Third-Party Services
CreatorMarket may allow Creators to connect supported third-party services, including Instagram, Facebook, TikTok, and YouTube.
Users may connect only accounts or pages that they own, control, or are authorized to manage.
By connecting a third-party service, you authorize CreatorMarket to access, retrieve, store, and use the information covered by the permissions you approve for the CreatorMarket features described at the time of connection and in the Privacy Policy. The connected information is initially made available within your CreatorMarket account, and connecting an account does not by itself publish that information.
You may separately select supported information or media for your CreatorMarket profile. When you set your CreatorMarket profile to public, all information and media included in that public profile may be viewed by anyone, including Brands, registered users, and visitors who are not signed in. Information that you have not added to your public CreatorMarket profile remains private and is not made visible through the profile. CreatorMarket displays selected profile information subject to the applicable third-party provider terms and policies.
You remain responsible for complying with the applicable provider's terms, policies, account rules, intellectual-property requirements, and community standards.
For TikTok, CreatorMarket requests read-only access to profile information, account statistics, and public-video information. CreatorMarket does not request permission to post, upload, edit, or delete content on TikTok.
CreatorMarket does not guarantee:
- the continued availability of an integration;
- the accuracy, completeness, or timing of third-party data;
- that a third-party provider will continue to offer an API, scope, metric, or feature;
- that a connected account will remain available or authorized; or
- that imported media will remain available at its original source.
CreatorMarket may modify, suspend, disconnect, or discontinue an integration where necessary because of provider changes, security concerns, suspected unauthorized access, non-compliance, or technical limitations.
CreatorMarket uses YouTube API Services. By using CreatorMarket features that access YouTube API Services, you agree to be bound by the YouTube Terms of Service available at https://www.youtube.com/t/terms.
18. Imported Media
The Platform may allow Creators to select and import supported images, profile pictures, thumbnails, or other media from a connected account for use on their CreatorMarket profile or portfolio.
By importing media, you represent that:
- you own it or have sufficient rights to use it;
- its use on CreatorMarket does not violate third-party rights;
- you understand that a copy or optimized version may be stored by CreatorMarket; and
- importing media does not by itself make it public; imported media becomes visible on CreatorMarket only if you separately add it to your profile or portfolio and set the applicable CreatorMarket profile to public.
An imported copy may not remain linked to or automatically update from the source platform.
CreatorMarket is not responsible if source media becomes unavailable, is removed, changes, or cannot be imported.
19. Platform Intellectual Property and Licence
CreatorMarket and its licensors own all rights in the Platform Content.
Subject to your compliance with these Terms, CreatorMarket grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Platform and its services for their intended purposes. For the avoidance of doubt, this right governs access to the CreatorMarket Platform and its services; the licence to use the CreatorMarket iOS application is separately governed by Apple's Standard Licensed Application End User License Agreement, as described in Section 28.
You must not, except where applicable law expressly permits:
- copy, modify, sell, lease, distribute, or create derivative works from the Platform;
- reverse engineer, decompile, or attempt to obtain source code;
- remove copyright, trademark, attribution, or proprietary notices;
- use CreatorMarket data or technology to build or train a competing service;
- use CreatorMarket branding without permission; or
- commercially exploit Platform Content outside the intended CreatorMarket service.
20. Fees and Changes to Pricing
Creating an account and using core marketplace functions may currently be free. CreatorMarket may offer optional paid features.
CreatorMarket may introduce or change fees, subscriptions, commissions, or paid features in the future. Any price applicable to a purchase will be shown before the User confirms that purchase.
Changes will not create a retroactive charge for a completed period unless the User expressly agrees or applicable billing rules provide otherwise.
Continued use of free features does not itself authorize CreatorMarket to charge a User.
21. Availability and Third-Party Services
The Platform is provided on an "as is" and "as available" basis.
CreatorMarket may perform maintenance, release updates, change technical requirements, impose reasonable usage limits, or suspend features.
The Platform may contain links to, display data from, or depend on third-party services. CreatorMarket does not control and is not responsible for the availability, content, security, policies, accuracy, or actions of those services.
Users access third-party services at their own risk and subject to the relevant third-party terms.
22. Suspension, Termination, and Account Deletion
You may stop using the Platform and request account deletion through the available account settings or deletion process.
CreatorMarket may warn, restrict, suspend, or terminate an account or access to specific features where reasonably necessary because:
- these Terms have been violated;
- information is materially false, misleading, or fraudulent;
- payment, security, legal, or regulatory risk exists;
- another User or third-party provider reports misuse;
- the account is connected to unlawful, abusive, or harmful conduct;
- required verification or information is not provided;
- the account is inactive for an extended period; or
- continued access may expose CreatorMarket or another person to harm or liability.
CreatorMarket may act immediately where reasonably necessary for security, safety, fraud prevention, legal compliance, or protection of Users.
Account deletion and retention of associated information are handled in accordance with the Privacy Policy and applicable law.
Termination does not affect rights, obligations, payments, licences, liabilities, or disputes that arose before termination.
23. Disclaimers
To the maximum extent permitted by applicable law, CreatorMarket disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.
CreatorMarket does not warrant that:
- the Platform will always be available, uninterrupted, secure, or error-free;
- errors or defects will always be corrected;
- User information or third-party data will be accurate or genuine;
- a User will perform, pay, deliver, or comply with an agreement;
- any Creator is suitable for a Brand or campaign;
- any Brand, campaign, budget, compensation, or payment promise is genuine or reliable;
- a badge, connected account, social metric, or document is authentic or current;
- the Platform will produce bookings, applications, income, exposure, engagement, sales, or any other result; or
- use of the Platform will satisfy a User's legal, regulatory, licensing, tax, or professional obligations.
CreatorMarket does not provide legal, tax, financial, licensing, advertising-compliance, employment, or other professional advice.
24. User Due Diligence and Assumption of Risk
Users must use their own judgment and conduct any checks they consider appropriate before:
- contacting, booking, paying, or engaging another User;
- relying on a profile, badge, social account, metric, package, campaign, document, or statement;
- granting access to products, property, systems, locations, confidential information, or intellectual property;
- entering into a collaboration; or
- publishing or using Creator work.
To the maximum extent permitted by law, each User assumes the risks associated with relying on another User's statements, entering into an agreement with another User, making or receiving payments outside the Platform, and using content or services supplied by another User.
25. Limitation of Liability
To the maximum extent permitted by applicable law, CreatorMarket, Synexo Data Technology L.L.C, and their officers, directors, employees, agents, affiliates, and service providers will not be liable for:
- indirect, incidental, special, exemplary, consequential, or punitive damages;
- loss of profit, revenue, business, goodwill, opportunity, anticipated savings, or data;
- actions, omissions, statements, fraud, misconduct, or contractual breaches of Users or third parties;
- incorrect, incomplete, outdated, manipulated, or fraudulent User information or third-party metrics;
- forged, altered, stolen, expired, revoked, or fraudulently submitted documents;
- non-payment, failed collaborations, quality disputes, missed deadlines, or campaign results;
- unauthorized use of User Content by another User;
- third-party service interruptions, API changes, account suspensions, or data errors;
- loss arising from reliance on a badge, profile, metric, price, campaign, compensation statement, booking, or message; or
- unauthorized access resulting from a User's failure to protect account credentials.
To the maximum extent permitted by law, CreatorMarket's total aggregate liability arising out of or relating to the Platform or these Terms will not exceed the greater of:
- the amount the relevant User paid directly to CreatorMarket for Platform features during the twelve months preceding the event giving rise to the claim; or
- AED 500.
The limitations in these Terms apply regardless of the legal basis of the claim and even if CreatorMarket was advised that damage was possible.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from CreatorMarket's own fraud, wilful misconduct, gross fault, or breach of mandatory legal obligations.
26. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless CreatorMarket, Synexo Data Technology L.L.C, and their officers, directors, employees, agents, affiliates, and service providers from claims, liabilities, losses, damages, judgments, penalties, and reasonable legal expenses arising from or related to:
- your use or misuse of the Platform;
- your User Content;
- information, metrics, documents, prices, campaign terms, or statements provided by you;
- your Creator Services or Brand campaign;
- your agreement, transaction, payment, or dispute with another User;
- your infringement of intellectual-property, privacy, publicity, confidentiality, or other rights;
- your breach of these Terms;
- your violation of applicable law or third-party terms; or
- fraud, misconduct, negligence, or harmful activity by you.
CreatorMarket may control the defence or settlement of a covered claim, and you agree to provide reasonable cooperation.
27. Privacy
CreatorMarket's Privacy Policy explains how personal information is collected, used, stored, shared, and deleted.
Where consent is legally required for optional processing, CreatorMarket will request it separately.
If these Terms and the Privacy Policy conflict concerning the processing of personal information, the Privacy Policy governs that privacy issue.
28. Apple App Store and Google Play
If you obtain the CreatorMarket iOS application through the Apple App Store, your licence to use the iOS application is governed by Apple's Standard Licensed Application End User License Agreement.
These Terms separately govern your CreatorMarket account, your use of the Platform and its marketplace features, User Content, bookings, communications, the CreatorMarket features and entitlements made available following a purchase, and your interactions with other Users.
For purchases made through the Apple App Store or Google Play, the applicable store terms and policies govern billing, payment processing, subscription renewal, cancellation, and refunds. These Terms continue to govern your use of the corresponding CreatorMarket features and entitlements, to the extent they do not conflict with applicable store terms or mandatory law.
If you obtain the CreatorMarket Android application through Google Play, your use of Google Play and the application is also subject to the applicable Google Play terms and policies.
Apple and Google are not parties to agreements between Brands and Creators and are not responsible for Creator Services, User Content, bookings, payments between Users, or disputes between Users.
29. Changes to These Terms
CreatorMarket may update these Terms to reflect changes to the Platform, law, business model, third-party services, security requirements, or policies.
For material changes, CreatorMarket will provide reasonable notice where appropriate, such as through the Platform, by email, or by updating the effective date.
The revised Terms apply from the stated effective date. If you do not agree to the revised Terms, you must stop using the Platform and may delete your account.
30. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai.
Before starting legal proceedings, the parties will attempt in good faith to resolve the dispute for at least thirty days after written notice, unless urgent interim relief is reasonably necessary.
Subject to any mandatory rights or jurisdiction that cannot lawfully be excluded, disputes arising out of or relating to these Terms or the Platform are subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
31. General Provisions
Entire Agreement
These Terms, together with the Privacy Policy and any expressly incorporated Platform rules, form the agreement between you and CreatorMarket concerning use of the Platform.
Severability
If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect.
No Waiver
Failure to enforce a provision does not waive the right to enforce it later.
Assignment
You may not assign or transfer your rights or obligations under these Terms without CreatorMarket's prior written consent. CreatorMarket may assign its rights and obligations as part of a merger, restructuring, sale, transfer of business, or by operation of law.
No Partnership
These Terms do not create an employment, partnership, franchise, joint venture, fiduciary, or agency relationship between CreatorMarket and a User, or between Users.
Force Majeure
CreatorMarket is not responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, war, civil disturbance, epidemics, government action, internet or cloud failures, power outages, labour disputes, cyberattacks, or third-party service interruption.
Headings
Section headings are for convenience only and do not affect interpretation.
Mandatory Rights
Nothing in these Terms removes rights or remedies that applicable law does not permit the parties to exclude or limit.
